Tax Lawyer (How To Get A Job In Tax Law) Taxes have been around since the early civilizations. In Egypt, the pharoahs put a tax on cooking oil. In ancient Greece, the taxes funded the military, and foreigners paid a tax. In Rome, Caesar Augustus delegated the responsibility for taxes to the cities, and developed the first inheritance tax.

The selection of decisions spans from 2005 through 2011 and is organized by jurisdiction. The decisions are listed in the order of frequency of citation. Treasury regulations are issued by the United States Internal Revenue Service (a bureau of the United States Department of the Treasury) and serve as an authoritative interpretation of the Internal Revenue Code.

We highlight three recent decisions:

In Burks v. US, 633 F. 3d 347 (5th Cir. 2011), the court rules that an overstatement of basis does not constitute an omission from gross income for purposes of the Tax Code, 26 U.S.C. § 6501(e)(1)(A), which extends the tax assessment period from three to six years.

In CIR v. Simmons, 646 F. 3d 6 (DC Cir. 2011), the court upholds a claim for deductions on donated conservation easements. It finds that the taxpayer satisfied the requirement of obtaining a qualified appraisal for the property contributed and that the conservation easements were "exclusively for conservation purposes."

The court in Dickow v. US, 654 F. 3d 144 (1st Cir. 2011) rules on an estate's eligibility for a refund. The court finds that the regulations barred the requested refund because the taxpayer was not entitled to a second extension of the filing deadline that determined the estate's eligibility for the refund.
