Though it’s commonly thought that law is a perennial career, today’s legal eagles are learning otherwise. And as recent news coverage suggests, most are in desperate need of guidance on how to keep their jobs and what to do if they’re let go. The legal landscape has shifted, and keen lawyers must know how to navigate it. With 25 years in legal career counseling, Hermann helps attorneys deal with downsizing in a precarious economy. The book provides a savvy outlook on the current job scene, with specifi c topics that include: opportunities impervious to economic flux; beating “recession depression”; using a law degree outside the “mainstream”; combining career opportunities; maximizing contacts; nailing an interview; and relocation considerations. This book focuses primarily on the job-search process for attorneys who’ve been recently displaced, with additional tips for those who wish to redirect their career focus as a result.Author: Richard Hermann Paperback: 288 pages Bargain Price Company: Kaplan Publishing (2009-10-06) (2009-10-06) List Price: $19.99 Amazon Price: $4.00 Used Price: $15.35
“Most jury trials are contests between the rich and poor.” Clarence Darrow wrote those words in an essay titled “How to Pick a Jury,” and they are as true today as they were when he penned them in 1936. Or, as William J. Chriss writes, “The law is democracy’s chosen profession, and jury trial is the most effective tool ever devised by democratic societies to check the authoritarian impulses of the rich and powerful.”So begins The Noble Lawyer, which takes this thesis and dissects it, along with thoroughly examining the sad state of the public’s current perception of attorneys—those brave men and women whose calling is to defend both the legal system and the very people who often criticize their profession. Frequently the subjects of jest and of mockery, attorneys now find themselves thought of as less than noble, derided more than respected, ridiculed rather than admired, and almost always misunderstood. Chriss tells us why that is and why it shouldn’t be. His defense of the legal profession is an eloquent and passionate one. Chriss summarizes how the American legal system came to be… and how it came to be in the state it’s in today. The Noble Lawyer is rich with examples from history, books, film, television, and modern life: examples of what it means to be a lawyer. Or, more importantly, what it should mean to be one. Every attorney should read this book. Everyone who knows an attorney should read this book. And we should all take from it a better understanding of why lawyers are so misunderstood and just how very wrong that is. Without attorneys, democracy itself could not exist. We have attorneys to thank for defending our every freedom, and we have William J. Chriss to thank for bringing this to our attention in The Noble Lawyer. Author: William J. The Challenge of Educating Lawyers"This volume, under the presidency of Lee Shulman, is intended primarily to foster appreciation for what legal education does at its best. We want to encourage more informed scholarship and imaginative dialogue about teaching and learning for the law at all organizational levels: in individual law schools, in the academic associations, in the profession itself. We also believe our findings will be of interest within the academy beyond the professional schools, as well as among that public concerned with higher education and the promotion of professional excellence." --From the Introduction "Educating Lawyers is no doubt the best work on the analysis and reform of legal education that I have ever read. There is a call for deep changes in the way law is taught, and I believe that it will be a landmark in the history of legal education." --Bryant G. Garth, dean and professor of law, Southwestern Law School and former director of the American Bar Foundation "Educating Lawyers succeeds admirably in describing the educational programs at virtually every American law school. The call for the integration of the three apprenticeships seems to me exactly what is needed to make legal education more 'professional,' to prepare law students better for the practice of law, and to address societal expectations of lawyers." --Stephen Wizner, dean of faculty, William O. Stress, power, and high expectations of the legal profession can leave lawyers especially vulnerable to addiction. What's more, personality traits that contribute to a lawyer's success can impede recovery. Don Carroll, the director of the North Carolina Lawyers Assistance Program (NCLAP), has written the definitive guide on addiction and depression in the legal profession. In A Lawyer's Guide to Healing, Carroll discusses the disease of addiction, how it affects addicted lawyers in every aspect of their lives, and how recovery can help lawyers reclaim their personal lives and professions.Author: Don Carroll J.D. Anthony Kronman describes a spiritual crisis affecting the American legal profession, and attributes it to the collapse of what he calls the ideal of the lawyer-statesman: a set of values that prizes good judgment above technical competence and encourages a public-spirited devotion to the law. For nearly two centuries, Kronman argues, the aspirations of American lawyers were shaped by their allegiance to a distinctive ideal of professional excellence. In the last generation, however, this ideal has failed, undermining the identity of lawyers as a group and making it unclear to those in the profession what it means for them personally to have chosen a life in the law. A variety of factors have contributed to the declining prestige of prudence and public-spiritedness within the legal profession. Partly, Kronman asserts, it is the result of the triumph, in legal thought, of a counterideal that denigrates the importance of wisdom and character as professional virtues. Partly, it is due to an array of institutional forces, including the explosive growth of the country's leading law firms and the bureaucratization of our courts. The Lost Lawyer examines each of these developments and illuminates their common tendency to compromise the values from which the ideal of the lawyer-statesman draws strength. It is the most important critique of the American legal profession in some time, and an an enduring restatement of its ideals.
In this penetrating book, Jean Stefancic and Richard Delgado use historical investigation and critical analysis to diagnose the cause of the pervasive unhappiness among practicing lawyers. Most previous writers have blamed the high rate of burnout, depression, divorce, and drug and alcohol dependency among these highly paid professionals on the narrow specialization, long hours, and intense pressures of modern legal practice. Stefancic and Delgado argue that these professional demands are only symptoms of a deeper problem: the way lawyers are taught to think and reason. They show how legal education and practice have been rendered arid and dull by formalism, a way of thinking that values precedent and doctrine above all, exalting consistency over ambiguity, rationality over emotion, and rules over social context and narrative. Stefancic and Delgado dramatize the plight of modern lawyers by exploring the unlikely friendship between Archibald MacLeish, who gave up a successful but unsatisfying law career to pursue his literary yearnings, and Ezra Pound. Reading the forty-year correspondence between MacLeish and Pound, Stefancic and Delgado draw lessons about the difficulties of attorneys trapped in worlds that give them power, prestige, and affluence but not personal satisfaction, much less creative fulfillment. Long after Pound had embraced fascism, descended into lunacy, and been institutionalized, MacLeish took up his old mentor’s cause, turning his own lack of fulfillment with the law into a meaningful crusade and ultimately securing Pound’s release from St. Elizabeths Hospital. Drawing on MacLeish’s story, Stefancic and Delgado contend that literature, public interest work, and critical legal theory offer tools to contemporary attorneys for finding meaning and overcoming professional dissatisfaction. Lawyers and the legal profession have become scapegoats for many of the problems of our age. In The Lawyer Myth: A Defense of the American Legal Profession, Rennard Strickland and Frank T. Read look behind current antilawyer media images to explore the historical role of lawyers as a balancing force in times of social, economic, and political change. One source of this disjunction of perception and reality, they find, is that American society has lost touch with the need for the lawyer’s skill and has come to blame unrelated social problems on the legal profession. This highly personal and impassioned book is their defense of lawyers and the rule of law in the United States. The Lawyer Myth confronts the hypocrisy of critics from both the right and the left who attempt to exploit popular misperceptions about lawyers and judges to further their own social and political agendas. By revealing the facts and reasoning behind the decisions in such cases as the infamous McDonald’s coffee spill, the authors provide a clear explanation of the operation of the law while addressing misconceptions about the number of lawsuits, runaway jury verdicts, and legal “technicalities” that turn criminals out on the street. Acknowledging that no system is perfect, the authors propose a slate of reforms for the bar, the judiciary, and law schools that will enable today’s lawyers—and tomorrow’s—to live up to the noble potential of their profession. Whether one thinks of lawyers as keepers of the springs of democracy, foot soldiers of the Constitution, architects and carpenters of commerce, umpires and field levelers, healers of the body politic, or simply bridge builders, The Lawyer Myth reminds us that lawyers are essential to American democracy. Trial and Error offers an unexpurgated examination of the past half-century of American jurisprudence through the life of one of America's most celebrated and accomplished lawyers. Here is John C. Tucker, a man who twice argued before the Supreme Court and won, challenged the nefarious and discriminatory practice of "contract lending" and lost, participated in such monumental cases as the Chicago Eight trial following the calamitous 1968 Democratic Convention—and retired at age fifty-one, securely established as one of the most respected jurists of his generation. In Trial and Error, he describes with poise and wit his encounters with as varied a cast of characters as Muhammad Ali, Abbie Hoffman, and Chief Justice Earl Warren, while chronicling the remarkable successes, and sobering disappointments, of his distinguished career. This is an honest and uncompromising analysis of the events that have shaped our court system, and the inspiring story of a man for principle in an increasingly unprincipled age for the legal profession. Every year, thousands of college graduates matriculate into law school, a process that requires extraordinary time, money, and effort. Despite these costs, many future lawyers don't know what a career in the law entails. Embarking on a career as an attorney can be rewarding, but it can also be regrettable. This book is meant to provide aspiring attorneys with the information they need to make a knowledgeable decision whether law school, and a career in the law, is the right choice. The book provides a broad overview of the different fields, practice areas, and career choices available to law graduates. Not every lawyer practices in a court room, or negotiates high stakes business deals. Although attorneys are often portrayed in entertainment and media, these portrayals are frequently distortions of an attorney's actual day-to-day work life. This book will lay out the work expected and performed by attorneys in different specialties. The book will also provide some insight regarding a prospective lawyer's career objectives. It is no longer safe to assume a law degree will be a key to financial security. Ultimately, this book will arm a prospective law student with the information they need to determine whether a career in the law fits their long-term life ambitions. A quarter-million Boomer lawyers are expected to start retiring by 2011. But what sort of retirement will it be, or should it even be called "retirement"? Especially when most lawyers have no desire to turn their back on work for a life of leisure ... especially in an uncertain economy. Lawyers at Midlife is not the traditional, feel-good retirement book. It's a detailed planning guide to help mid- and late-career lawyers lay the financial, medical, and social groundwork for the next chapter of their lives.Author: Michael Long, John Clyde, Pat Funk Paperback: 228 pages Company: Decisionbooks (2008-10) ISBN: 0940675609 List Price: $35.00 Amazon Price: $22.98 Used Price: $20.91
This is a biography of the early years of a somewhat successful legal career. It lacks the aphrodisiac of star quality, but what it provides is closer to common ground, and in that sense more valuable. Within these pages I have portrayed my sometimes painful, sometimes exhilarating coming of age as a trial lawyer in post mid-century Nashville, Tennessee. There is plenty of drama, much ridiculousness, and most of all an abiding sense of humanity, created by the collision of an earnest, young lawyer on the lower rungs of the American System of Justice with the system itself. The comedy, tragedy, carelessness, and sometimes good lawyering chronicled here have been experienced from time immemorial by fledgling lawyers, whose energy and idealism temporarily overcomes the cynicism that so often dominates our legal system. If these stories seem to validate our system of justice, this old lawyer’s judgment of that system will have been accurately conveyed. The stories tend to demonstrate that a system which ultimately rests upon the judgment of twelve people, while far from perfect, is superior to anything else the world has managed to devise for resolving society’s disputes. Even an awkward young lawyer, battered as he sometimes was by the system, perceived that basic truth and carried it with him for the rest of his professional life. Praise for The Unfinished Agenda of Brown V. Board of Education"My father, Oliver L. Brown, for whom Brown v. Board of Education is named, was a proud member of a group of a few hundred people, across the country, who took risks by taking a stand for what they believed. He died in 1961, just seven years after the case, so he didn't live long enough to know that Brown would become the foundation on which so much of this country's civil and human rights initiatives would rest. Brown v. Board became important for every citizen, not just African Americans. It shows that the founding documents of our country provided us with sovereign rights that cannot be restricted by state and local governments. That decision impacted the lives of women, persons with disabilities, blacks, whites, Hispanics, Asians, and everyone living in this country. Brown was significant in attacking the silence. It opened up a dialogue and forced the country to take on greater responsibility; we at every level had to start addressing the issue of race. In many ways, once the dialogue started, we finally began to under stand the depths of racism. This case was about gaining access to educational resources; the resources were and remain where the white children are. The Unfinished Agenda of Brown v. Board of Education is about renewing and continuing the promise of Brown." -Cheryl Brown Henderson, president of the Brown Foundation for Educational Equity, Excellence, and Research, and daughter of Oliver L. Are you thinking of attending law school or switching legal careers? About to graduate and wondering which path to take? Are you curious about what lawyers in different fields do in a typical day? Then spend twenty-four hours with twenty-four lawyers through this innovative book, 24 Hours with 24 Lawyers. Whether you want to be a full-time corporate lawyer, work as a legal consultant while pursuing your music career, or anything in between, this book gives you a unique "all-access pass" into the real-world, real-time personal and professional lives of twenty-four law school graduates. These working professionals each present you with a "profile" chronicling a typical twenty-four-hour day in their traditional and non-traditional careers. You will read actual twenty-four-hour accounts from the perspective of a venture capitalist, Wall Street lawyer, lobbyist, entertainment lawyer, IP attorney, sports broadcaster, JAG officer, prosecutor, criminal defense lawyer, mediator, and politician, just to name a few. From the time they wake up in the morning to the time they go to bed, each professional illustrates what their position entails on a day-to-day basis and will give you invaluable, informative, and honest insight above and beyond what many brochures, guest lectures, career workshops, or law firm website descriptions can provide. After reading 24 Hours with 24 Lawyers, you'll be better prepared to determine which career profile may suit you best before accepting a new job or investing in a legal education. About the Author Jasper Kim has worked in various traditional and non-traditional careers as - a lawyer, banker, consultant, author, columnist, and academic - since graduating from law school. He is department chair and associate professor at Ewha Womans University, where he was director of the university's Global Career Management Center, and is adjunct faculty at Pepperdine University's School of Law. He was previously a lawyer and investment banker with Lehman Brothers and Barclays Capital, and is now a frequent contributor to The Wall Street Journal, CNBC TV, BBC TV, and Bloomberg TV. Mr. Kim has been selected as a 2011 Visiting Scholar at Harvard University.
