In Suing the Tobacco and Lead Pigment Industries, legal scholar Donald G. Gifford recounts the transformation of tort litigation in response to the challenge posed by victims of 21st-century public health crises who seek compensation from the product manufacturers. Class action litigation promised a strategy for documenting collective harm, but an increasingly conservative judicial and political climate limited this strategy. Then, in 1995, Mississippi attorney general Mike Moore initiated a parens patriae action on behalf of the state against cigarette manufacturers. Forty-five other states soon filed public product liability actions, seeking both compensation for the funds spent on public health crises and the regulation of harmful products.
 
Gifford finds that courts, through their refusal to expand traditional tort claims, have resisted litigation as a solution to product-caused public health problems. Even if the government were to prevail, the remedy in such litigation is unlikely to be effective. Gifford warns, furthermore, that by shifting the powers to regulate products and to remediate public health problems from the legislature to the state attorney general, parens patriae litigation raises concerns about the appropriate allocation of powers among the branches of government.

Urban renewal efforts are a priority for many American cities. As efforts to reconstitute urban centers increase, the demolition of old, deteriorated structures has accelerated. Recent studies have identified demolitions as a potential source of environmental lead exposure. We conducted a study examining the relationship between demolition activity and blood lead levels of children residing in neighborhoods where demolition activity occurred. A retrospective cohort study was conducted in St. Louis City, Missouri. The study period was January 1, 2002 to December 31, 2002. Data were obtained from the Missouri Childhood Lead Poisoning Prevention Program's (CLPPP) lead surveillance system and St. Louis Demolition Permit Database. Children were considered exposed to a demolition if they had a blood lead test within 45 days of any demolition on a census block. Exposure was classified as both a dichotomous (yes/no) and a categorical (none/one/multiple) variable and was analyzed separately. Linear regression models were developed to determine effects of demolitions on blood lead levels. A total of 1196 children 6-72 months of age living in 395 census blocks were included. 314 (26.3%) were exposed and 882 (73.7%) were unexposed to a demolition. In an adjusted model, exposure to multiple demolitions was found to have significant effects on children blood lead levels (coefficient=0.281; 95% CI=0.069, 0.493; P-value=0.010). Age of the child, race, and age of housing where children's resided were also significant predictors. This study suggests that multiple demolitions within a census block may significantly increase children's blood lead levels. The findings may be useful to municipal planners in older cities where demolitions are being used as an urban renewal tool.

Not illustrated. 1914 Excerpt: ...because to shut off any considerable part of the flue system interferes with the working of the furnaces. Thirty or 40 men are often put on at once and when the work is not let out on contract the men are not required to work for long hours. Sometimes they work only five hours a day. As to the sprinkling of the flue dust, one manager says that it is possible to sprinkle the bag-house dust, but not that in the flues, because the latter is hot and the steam would be excessive. Usually the opinion is that if the sulphate in flue dust is all combined, as it is in the dust from copper converters and from white lead, it can be dampened down without harm, but dust from reverberatory furnaces has free SOs which with the water would form sulphuric acid and eat into men's clothing and cause painful burns on their skin. The success of the Midvale system comes from the neutralization of the S03 practiced there. However, even in bag houses and flues which receive only lead sulphate dust, without free SOs, the dust is sometimes handled dry, because sprinkling is said to stir up so much dust. Of course if the trouble from sulphuric acid could be eliminated there is no comparison between the danger of working with wet paste and with fluffy dust. As to the objection to sprinkling that it raises so much dust, this is true, as can be seen in any dusty street when the stream from a hose is turned on it with too much force, but no one would advocate cleaning the street by dry sweeping instead. The dust can be laid without much difficulty by a slower sprinkling. In those plants where the flue dust is made into briquettes there is a real advantage in having the stuff already damp and pasty. Muller objects on practical grounds to wetting the dust in the flues, because if the water...
